Agreement

Fresh Dabba (“Fresh Dabba,” “we,” “us”) provides a website and related services (the “Services”) for ordering fresh, home-style vegetarian Indian meals for delivery in the greater Houston, Texas area. These Terms govern your use of the Services.

You must be able to enter a binding contract in your jurisdiction (typically 18 or older, or the minimum age required where you live). You are responsible for activity under your account and for keeping login credentials private.

What we provide

The Services let you browse published menus, select meals and add-ons, schedule delivery within our service windows, manage weekly or monthly plans where offered, and communicate with our team. Menus, prices, ZIP coverage, windows, and cutoffs can change as operations evolve; we work to keep the site accurate but occasional errors may occur.

Orders & payment

  • Confirmation: an order is confirmed when our systems or team acknowledge it according to our workflow — not merely when you click submit. We may decline or cancel orders for capacity, safety, fraud prevention, or operational reasons.
  • Pricing: prices at checkout apply unless clearly stated otherwise. Applicable taxes or fees are shown where required.
  • Payment methods: such as Zelle or cash on delivery are presented at checkout or in your account. You agree to pay amounts when due and to include accurate payment references (for example, order numbers in Zelle notes).

Delivery & cutoffs

Delivery is limited to areas and ZIP codes we serve, as listed on the site. Delivery windows and cutoffs (including evening cutoffs for next-day lunch) are part of how a small kitchen plans production. Missing a cutoff may move your meal to the next eligible date. You are responsible for accurate addresses, gate codes, and safe, accessible drop-off locations. We are not responsible for failed delivery due to incorrect instructions, locked communities without access, or customer unavailability.

Weekly & recurring plans

Weekly or monthly plans may include auto-scheduling, skip days, add-ons, and change requests subject to published deadlines. Review your plan settings and cutoffs in your account (or guest track page where supported). Changes submitted after a cutoff may not apply to the next delivery day. Owner-approved change requests follow the same operational rules whether you are logged in or using a guest track link.

Guest checkout

You may order without an account. Guest orders receive transactional communications and may include a secure track link. You are responsible for safeguarding that link. Guest self-serve tools (where enabled) are limited compared to full accounts — for example, some add-ons or billing features may require signing up. Creating an account later may link prior guest orders when you verify the same contact details we have on file.

Cancellations, changes & refunds

Whether we can cancel, reschedule, or refund depends on order status, timing relative to cutoffs, and whether food is already prepared or en route. We handle reasonable requests in good faith. Unless required by law, refunds are not guaranteed for orders already made, dispatched meals, or issues caused by customer error (wrong address, unavailable recipient, etc.).

Food safety & allergies

Meals are prepared in a shared vegetarian kitchen. We take hygiene seriously, but trace allergens may be present unless we agree in writing to a specific accommodation. Severe allergies are at your own risk unless we explicitly confirm otherwise. Review menu notes and tell us about dietary needs through the channels we provide.

Acceptable use

You agree not to:

  • Use the Services unlawfully or to harass our team or other customers.
  • Attempt unauthorized access to systems, accounts, or guest track tokens belonging to others.
  • Scrape or overload our infrastructure with automated traffic.
  • Place fraudulent orders or misrepresent your identity.

We may suspend or terminate access for violations or conduct that harms the Service or others.

Our content

Branding, menus, photos, text, and software on the Services are owned by Fresh Dabba or our licensors. You receive a limited, personal, non-commercial license to use the Services for ordering. No other rights are granted.

Third-party integrations (hosting, auth, email, SMS, maps) are subject to their own terms. We are not responsible for third-party outages outside our reasonable control.

Disclaimers & liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESH DABBA AND OUR OWNERS, STAFF, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You agree to indemnify Fresh Dabba against claims arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

Texas law & disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to applicable law, disputes will be brought in state or federal courts in Harris County, Texas, and you consent to personal jurisdiction there.

We may update these Terms; the date on this page will change and material updates may be communicated by email or site notice. Continued use after changes means acceptance. You may stop using the Services anytime; we may suspend access for violations. Sections that should survive termination (intellectual property, disclaimers, liability limits, indemnity, governing law) remain in effect.
